By using the BestTime.app website and its associated services ("Service"), you are agreeing to be bound by the following terms and conditions ("Terms of Service").
BestTime.app ("Company") reserves the right to update and change these Terms of Service without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes.
Violation of any of the terms below may result in the termination of your Account.
1. Account Terms
- You must be a human. Accounts registered by "bots" or other automated methods are not permitted.
- You must provide your legal full name, a valid email address, and any other information requested to complete the signup process for a paid subscription.
- Your login may only be used by one person. A single login shared by multiple people is not permitted. You may create separate logins for as many people as your plan allows.
- You are responsible for maintaining the security of your account and password. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
- You are responsible for all content posted and activity that occurs under your account.
- You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
2. Payment, Refunds, and Plan Changes
- The Service is offered with a free plan and optional paid subscriptions. For paid plans, you will be billed in advance on a recurring basis. If you fail to pay, your account may be downgraded or suspended.
- All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities. You shall be responsible for payment of all such taxes, levies, or duties.
- Downgrading your Service may cause the loss of features or capacity of your Account. The Company does not accept any liability for such loss.
- Refund requests are considered on a case-by-case basis. To request a refund, please contact support@besttime.app within 30 days of the payment. We do not offer prorated refunds for cancellations. Please do not dispute a payment before contacting us.
3. Cancellation and Termination
- You are solely responsible for properly canceling your account. You can cancel your subscription at any time from your account's Settings page. An email or phone request to cancel your account is not considered a cancellation.
- If you cancel a paid plan, your subscription will remain active until the end of your current billing cycle, and you will not be charged again.
- Upon cancellation, your content will be immediately inaccessible. Within 30 days, this content will be permanently deleted from our systems and backups. This information cannot be recovered once it has been permanently deleted.
- The Company, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service for any reason at any time. Such termination will result in the deactivation or deletion of your Account. The Company reserves the right to refuse service to anyone for any reason at any time.
4. Modifications to the Service and Prices
- The Company reserves the right at any time to modify or discontinue, temporarily or permanently, any part of the Service with or without notice.
- Prices of all Services are subject to change upon 30 days' notice from us. Such notice may be provided at any time by posting the changes to the BestTime.app site or the Service itself.
- The Company shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
5. Copyright and Content Ownership
- We claim no intellectual property rights over the material you provide to the Service. All materials you upload remain yours.
- The look and feel of the Service is copyright © BestTime.app. All rights reserved. You may not duplicate, copy, or reuse any portion of the HTML, CSS, JavaScript, or visual design elements without express written permission from the Company.
- API Data Usage and Redistribution. You are permitted to use data retrieved from the Service's API within your commercial applications, products, or services where the data is presented to end-users as part of a functional user interface (a "Derivative Work"). However, you are expressly prohibited from redistributing, reselling, sublicensing, or otherwise making the raw or analyzed data from the Service available for profit as a standalone product or on a data marketplace. This restriction is intended to prevent the creation of services that directly replicate the core data offerings of BestTime.app. If your use case involves the redistribution or resale of our data, you must obtain prior written permission from the Company. We are open to discussing partnership and licensing agreements; please contact support@besttime.app to discuss your needs.
6. Data Availability and Accuracy
- Nature of Data: You acknowledge that the foot traffic data, including forecasts and live data, provided by the Service is based on aggregated and anonymized signals from external, third-party sources. The Service provides relative foot traffic data (expressed as percentages) and does not provide absolute visitor counts.
- Data Availability is Not Guaranteed: The availability and accuracy of this data for any given venue depend on a sufficient volume of these external signals. The Company cannot guarantee the continuous availability of foot traffic data, forecasts, or live data for any specific venue. A venue may have data available at one point in time and not at another due to fluctuations in signal volume or other external factors beyond the Company's direct control.
- Service Limitation: You agree that the absence or fluctuation of data for a specific venue is an inherent limitation of the Service and does not constitute a failure or breach of service.
7. General Conditions & Limitation of Liability
- Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis.
- Technical support is provided via email only, to support@besttime.app.
- You understand that the Company uses third-party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
- You must not modify, adapt, or hack the Service or modify another website so as to falsely imply that it is associated with the Service.
- You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission of the Company.
- The Company does not warrant that (i) the service will meet your specific requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, or information will meet your expectations, and (v) any errors in the Service will be corrected.
- You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the Company has been advised of the possibility of such damages).
- The failure of the Company to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and the Company and governs your use of the Service, superseding any prior agreements.
